Support Orders

Your benefits may be subject to a court order requiring PERS to pay benefits to an alternate payee (e.g., your spouse or former spouse). Your pension, IAP benefit, Tier One or Tier Two disability retirement benefit, OPSRP disability benefit, death benefit, or account balance that may be due to you will be paid to an alternate payee to the extent provided for in the terms of any court order or court-approved property settlement agreement that is part of any court order or decree of annulment, divorce, or separation.

Specific account information must be requested and authorized in writing by the court or the member. PERS will only release information to a member's attorney if that member provides us with a signed authorization to release information.

Your benefits may also be subject to a court order for the payment of child or spousal support.
