PERS Retirement Plan Options for Legislators

Xs represent the options available based upon the legislator’s status when taking office.

A legislator must make one of the available elections within 30 days of taking office in each term.

Elect Oregon Public Service Retirement Plan (OPSRP) membership for legislative service

Elect active Tier One membership for legislative service

Elect active Tier Two membership for legislative service

Elect to be a legislator member of the state deferred comp program (Oregon Savings Growth Plan)

Decline to participate in a retirement plan for legislative service

NO PRIOR PERS MEMBERSHIP: You must choose to be a member of the state deferred comp program (Oregon Savings Growth Plan) within 30 days of taking office or you will not be able to participate in a retirement plan for your legislative service.

NON-RETIRED TIER ONE MEMBER: You must make one of the available elections within 30 days of taking office in each term or you will become an active Tier One member.

RETIRED TIER ONE MEMBER: You must make one of the available elections within 30 days of taking office in each term or you will remain a retired Tier One member and will not accrue additional benefits for the legislative service. Regardless of the election, you can continue to receive retirement benefits for non-legislative service. However, any retirement benefit for past legislative service will stop and you will have to reapply for those benefits after leaving legislative service.
