Non-Duty Disability

To qualify for a non-duty disability A disability caused by an injury or disease that was not sustained while performing duties on the job. retirement, you must:

• Have 10 years or more years of qualifying service as a Tier One or Tier Two member.

• Apply within six calendar months from the date you last worked for a PERS-participating employer. Continuous disability from last day worked is not required. If you don’t apply within the six months, you may apply within five calendar years from the date you last worked for a PERS-participating employer; however, you must show continuous disability from your last day physically on the job with your PERS-participating employer, and you must not have worked in any other capacity since your PERS-participating employment.

• Be totally, not partially, disabled.
• Anticipate that you will be unable to perform any work for which you are qualified for a minimum of 90 consecutive days.
