Duty Disability Retirement
If your injury or disease was sustained while in the actual performance of duty in PERS-participating employment, you may apply for duty disability retirement regardless of your length of service. Your work must have been the material contributing cause of your injury or disease and you must:
- Apply within six calendar months from the date you last worked for a PERS-participating employer. Continuous disability from last day worked is not required. If you don’t apply within the six months, you may apply within five calendar years from the date you last worked for a PERS-participating employer; however, you must show continuous disability from your last day physically on the job with your PERS-participating employer and you must not have worked in any other capacity since your PERS-participating employment.
- Have established membership as a Tier One or Tier Two member.
- Be totally, not partially, disabled.
- Anticipate that you will be unable to perform any work for which you are qualified for a minimum of 90 consecutive days.
